The Apex Office of the Commissionerate of State Goods and Services Tax (SGST), Assam, have arrested one Ujjawal K. Agarwal in connection with a fake Input Tax Credit (ITC) case.
According to a press release from the department on Thursday, October 9, the operation leading to Agarwal’s arrest began on September 19, and it was a part of the department’s continued efforts to curb tax evasion. The total detected turnover in the case amounts to around ₹66 crore, with tax evasion estimated at 12 crore.
According to the Finance (Taxation) Department, an inspection and search were conducted under Section 67(2) of the GST Act at Agarwal’s business premises in Tinsukia under the name M/s. BKS Enterprises. The operation concluded on September 20. However, Agarwal reportedly failed to appear before GST authorities despite repeated summons and absconded.
A notice under BNSS 35(3) was later issued, asking him to appear on October 3, at Kar Bhawan, Dispur. The notice was also shared electronically, but Agarwal did not comply. Multiple attempts to contact him through phone calls also went unanswered until October 7.
With assistance from Assam Police, GST officers eventually traced Agarwal to a residence in Ankur Path, Survey, Guwahati. He was found at the house of his friend, Nikshay Sarawgi, and detained from the bathroom by the joint team. Following his arrest, Agarwal was taken to Kar Bhawan for interrogation regarding his alleged role in issuing fake ITC through bogus billing without the supply of goods or services.
Agarwal was later produced before the Chief Judicial Magistrate (CJM) Court, Guwahati, where his bail plea was rejected. He was subsequently remanded to judicial custody for 14 days.
